Some clients prefer a Legal Separation where the marriage is still intact and the door is still open for Reconciliation in the future. Others have no intention of reconciliation, but want to keep the federal benefits of legal marriage available, such as taxes, Social Security, Retirement, survivor spouse, etc. – while ensuring community property and debt is legally divided.
During a legal separation proceeding, if one party decides that he or she wishes to obtain a divorce, the process can easily be converted to a divorce proceeding (the process in Arizona is the same).
